Cooch and Taylor attorney Blake A. Bennett recently served as Delaware Counsel in two class action lawsuits that resulted in significant benefits for the respective classes.
First, Cooch and Taylor served as Delaware Counsel to Plaintiff Robert Hurwitz in his challenge of Vanguard Natural Resources LLC’s acquisition of LRR Energy L.P. After several years of litigation in the United States District Court for the District of Delaware, the Defendants agreed to resolve Plaintiff’s claims through a settlement agreement. That settlement resulted in the creation of an $8,000,000 settlement fund for former LRR unit holders. After conducting a preliminary and a final approval hearing, the Court approved the class settlement and plan of allocation in its December 19, 2018 Amended Judgment Order.
Second, Cooch and Taylor served as Delaware Counsel to Plaintiff Matthew Steve in his challenge of Sientra Inc.’s acquisition of Miramar Labs Inc. Through their litigation efforts in the Court of Chancery, Cooch and Taylor and their co-counsel were able to attain a 100% premium over the cash consideration that former Miramar Labs stockholders received in the merger. On January 15, 2019, the Court of Chancery approved the parties’ settlement agreement and noted: “I'm satisfied this is clearly a fair and reasonable settlement. In fact, I think it's an excellent settlement.”
